News Haveli, नई दिल्ली। सुप्रीम कोर्ट (Supreme Court) ने केंद्र और पश्चिम बंगाल की सरकार को “एक आखिरी मौका” देते हुए अवैध बांग्लादेशियों (Illegal Bangladeshi) को लेकर रुख साफ करने को कहा है। शीर्ष अदालत ने दोनों से जवाब तलब करते हुए पूछा है कि आखिर क्यों सैकड़ों लोगों को अनिश्चितकाल तक डिटेंशन कैंप्स (Detention Camps) में रखा जा रहा है जबकि वे विदेशी अधिनियम, 1946 (Foreigners Act, 1946) के तहत दोषी ठहराए जा चुके हैं।
न्यायमूर्ति जेबी पारदीवाला और न्यायामूर्ति आर महादेवन की पीठ ने कहा कि कानून को पढ़ने से पता चलता है कि पूरी प्रक्रिया यानी निर्वासन, सत्यापन आदि की प्रक्रिया 30 दिनों की अवधि के भीतर पूरी की जानी चाहिए। हम जानना चाहते हैं कि इस कानून का पालन क्यों नहीं किया जा रहा है? यह भी पूछा कि जब खुद केंद्र की गाइडलाइन के अनुसार अवैध बांग्लादेशी प्रवासियों को 30 दिनों के अंदर डिपोर्ट किया जाना चाहिए तो फिर इसका पालन क्यों नहीं किया जा रहा? सुप्रीम कोर्ट की पीठ उस मामले पर सुनवाई कर रही थी जो पहले कलकत्ता हाई कोर्ट में दर्ज हुआ था और बाद में सुप्रीम कोर्ट में ट्रांसफर कर दिया गया।
इतने लंबे समय से डिटेंशन में ही क्यों?
दो सदस्यीय पीठ ने 30 जनवरी के आदेश में साफ तौर पर कहा कि अगर कोई अवैध प्रवासी विदेशी अधिनियम, 1946 के तहत दोषी साबित हो जाता है तो यह सिद्ध हो जाता है कि वह भारतीय नागरिक नहीं है। ऐसे में सवाल यह है कि उन्हें अनिश्चितकाल तक डिटेंशन कैंप्स में रखने का क्या औचित्य है?
सुप्रीम कोर्ट ने कहा कि इस मुद्दे को उसके सामने आए 12 साल हो चुके हैं लेकिन अब तक कोई ठोस प्रगति नहीं हुई। तब लगभग 850 अवैध बांग्लादेशी प्रवासी (Illegal Bangladeshi Migrant) डिटेंशन में थे। “द इंडियन एक्सप्रेस” की रिपोर्ट के अनुसार, अब सुप्रीम कोर्ट ने केंद्र से यह आंकड़ा मांगा है कि वर्तमान में कितने प्रवासी डिटेंशन सेंटरों में बंद हैं जिन्होंने अपनी पूरी सजा पूरी कर ली है।
“अवैध प्रवासियों के डिपोर्टेशन में देरी क्यों?”
सुप्रीम कोर्ट के अनुसार, इस मामले में मुख्य मुद्दा यह है कि अगर कोई अवैध प्रवासी दोषी करार दिया जाता है और उसने अपनी सजा पूरी कर ली है तो उसे तुरंत उसके देश भेजा जाना चाहिए या फिर उसे अनिश्चितकाल के लिए भारत में रखा जाए? सुप्रीम कोर्ट के अनुसार, यदि कोई प्रवासी विदेशी अधिनियम, 1946 की धारा 14 ए (बी) के तहत गिरफ्तार होता है और उसे सजा दी जाती है तो फिर विदेश मंत्रालय को उसकी नागरिकता की आगे और पुष्टि करने की जरूरत क्यों पड़ती है?
गाइडलाइन का पालन क्यों नहीं?
सुप्रीम कोर्ट ने केंद्र सरकार के 25 नवंबर 2009 के एक सर्कुलर के क्लॉज 2(वी) का भी जिक्र किया। इसमें कहा गया था कि डिपोर्टेशन और वेरिफिकेशन की पूरी प्रक्रिया 30 दिनों के अंदर पूरी हो जानी चाहिए। अदालत ने सरकार से सवाल किया कि इस नियम का सख्ती से पालन क्यों नहीं किया जा रहा?
यह मामला पश्चिम बंगाल से जुड़ा हुआ है। सुप्रीम कोर्ट ने केंद्र सरकार से यह भी पूछा कि राज्य सरकार को इस मामले में क्या कदम उठाने चाहिए? कोर्ट ने केंद्र सरकार और पश्चिम बंगाल सरकार को अंतिम अवसर देते हुए कहा कि वे अगली सुनवाई (6 फरवरी 2025) तक इस मुद्दे पर अपना पक्ष लिखित रूप में स्पष्ट करें।
सुप्रीम कोर्ट ने कहा, “हम केंद्र और पश्चिम बंगाल सरकार दोनों को एक आखिरी मौका देते हैं कि वे मामले के सभी प्रासंगिक पहलुओं को स्पष्ट करते हुए एक उचित रिपोर्ट या हलफनामे के माध्यम से अपना रुख रिकॉर्ड पर रखें।”
