नई दिल्ली। इंडियन मेडिकल एसोसिएशन बनाम वीपी शांता मामले में 1995 के फैसले पर पुनर्विचार करने से इनकार करने वाले सुप्रीम कोर्ट (Supreme Court) के 7 नवंबर के आदेश के खिलाफ पुनर्विचार याचिका (Review Petition) दायर की गई है। सुप्रीम कोर्ट के उस फैसले के खिलाफ पुनर्विचार याचिका (रिव्यू पिटीशन) दाखिल की गई है। इस फैसले में कहा गया था कि डॉक्टर उपभोक्ता संरक्षण अधिनियम 1986 (जैसा कि 2019 में फिर से लागू किया गया)  के दायरे में आता है। याचिका में कहा गया है कि सुप्रीम कोर्ट द्वारा दिए गए फैसले पर विचार करने की जरूरत है। दरअसल, बीते 7 नवंबर को सुप्रीम कोर्ट ने इस मामले में दोबारा विचार करने से इनकार कर दिया था।

सुप्रीम कोर्ट 29 अप्रैल 2022 के फैसले में कहा था कि डॉक्टरों द्वारा मुहैया कराया जाने वाला हेल्थकेयर सर्विस उपभोक्ता संरक्षण अधिनियम 1986 के दायरे में आती है। यानी मरीज उपभोक्ता के तौर पर डॉक्टर के खिलाफ शिकायत कर सकता है। बॉम्बे हाई कोर्ट के आदेश के खिलाफ मेडिको लीगल एक्शन ग्रुप ने अर्जी कर आदेश को चुनौती देते हुए कहा था कि कंज्यूमर डॉक्टर के खिलाफ उपभोक्ता संरक्षण अधिनियम के तहत शिकायत दर्ज नहीं कर सकता है। सुप्रीम कोर्ट के तत्कालीन न्यायाधीश डीवाई चंद्रचूड़ की अगुवाई वाली बेंच के सामने यह मामला आया था।बॉम्बे हाई कोर्ट के आदेश के खिलाफ अपील दाखिल करने वाले मेडिको लीगल एक्शन ग्रुप संगठन की अर्जी सुप्रीम कोर्ट ने खारिज कर दी। सुप्रीम कोर्ट ने कहा था कि 1986 के कानून को खत्म कर उपभोक्ता संरक्षण अधिनियम 2019 बनाया गया है और सिर्फ कानून को खत्म कर नए कानून बनाए जाने भर से हेल्थ केयर सर्विस जो डॉक्टर मुहैया कराता है वह सर्विस के परिभाषा से बाहर नहीं हो सकती। इसके बाद याचिकाकर्ताओं ने पुनर्विचार याचिका दाखिल की थी जिसे सुप्रीम कोर्ट ने 7 नवंबर को खारिज कर दिया था जिसके बाद फिर रिव्यू दाखिल की गई है।
