नई दिल्ली। सुप्रीम कोर्ट (Supreme Court) ने गुरुवार को एक महत्वपूर्ण फैसले में कहा कि एक महिला अपने “स्त्रीधन” (streedhan or women’s wealth) की एकमात्र मालकिन है। इसमें विवाह के समय उसके माता-पिता द्वारा दिए गए सोने के आभूषण और अन्य सामान शामिल हैं। तलाक के बाद महिला के पिता को उसके पूर्व ससुराल वालों से उन उपहारों को वापस मांगने का कोई अधिकार नहीं है
यह मामला पी. वीरभद्र राव नाम के व्यक्ति से जुड़ा है जिनकी बेटी की शादी दिसंबर 1999 में हुई थी और शादी के बाद दंपती अमेरिका चला गया था। 16 साल बाद बेटी ने तलाक के लिए अर्जी दी और फरवरी 2016 में अमेरिका के मिजूरी राज्य की एक अदालत ने आपसी सहमति से तलाक दे दिया। तलाक के समय दोनों पक्षों के बीच एक समझौते के तहत सारी संपत्ति का बंटवारा कर दिया गया था। इसके बाद महिला ने मई 2018 में दोबारा शादी कर ली।
तीन साल बाद पी. वीरभद्र राव ने अपनी बेटी के ससुराल वालों के खिलाफ हैदराबाद में “स्त्रीधन” वापस मांगने के लिए एक प्रथम सूचना रिपोर्ट (FIR) दर्ज कराई। ससुराल पक्ष ने एफआईआर रद्द करवाने के लिए तेलंगाना हाई कोर्ट का दरवाजा खटखटाया लेकिन उन्हें सफलता नहीं मिली। इसके बाद उन्होंने सुप्रीम कोर्ट में अपील दायर की। न्यायमूर्ति करोल ने अपने फैसले में लिखा, “आम तौर पर स्वीकृत नियम, जिसे न्यायिक रूप से मान्यता दी गई है, वह यह है कि महिला को संपत्ति पर पूर्ण अधिकार होता है।”

सुप्रीम कोर्ट की पीठ ने आगे कहा, “इस अदालत का रुख स्पष्ट रूप से महिला (पत्नी या पूर्व पत्नी, जैसा भी मामला हो) के “स्त्रीधन” की एकमात्र मालिक होने के अधिकार के संबंध में साफ है। पति का कोई अधिकार नहीं है और इसलिए यह निष्कर्ष निकाला जाना चाहिए कि पिता को भी कोई अधिकार नहीं है जब बेटी जीवित है, स्वस्थ है और अपने “स्त्रीधन” की वसूली जैसे निर्णय लेने में पूरी तरह सक्षम है।”
कानून बदला लेने का साधन नहीं
सुप्रीम कोर्ट की पीठ ने कहा, “आपराधिक कार्यवाही का उद्देश्य गलत काम करने वाले को न्याय के कटघरे में लाना है। यह उन लोगों के खिलाफ बदला लेने या प्रतिशोध लेने का साधन नहीं है जिनके साथ शिकायतकर्ता की दुश्मनी हो सकती है।”
यह बात गई पिता के खिलाफ
इस मामले में पिता के खिलाफ एक और पहलू यह था कि उन्होंने बहुत ही देरी से “स्त्रीधन” (streedhan) की वापसी के लिए आपराधिक कार्यवाही शुरू की। अपनी बेटी की शादी के दो दशक से ज्यादा समय बीत जाने और यहां तक कि तलाक के पांच साल बाद जब उनकी बेटी की दूसरी शादी के भी तीन साल हो चुके थे, तब उन्होंने आपराधिक कार्यवाही शुरू की।
“स्त्रीधन” का कोई सबूत भी पेश नहीं किया
न्यायामूर्ति करोल ने कहा कि पिता के दावे के खिलाफ एक और महत्वपूर्ण पहलू यह है कि उन्हें उनकी बेटी ने “स्त्रीधन” की वसूली के लिए कोई अधिकार नहीं दिया था। अदालत ने यह भी पाया कि पिता ने 1999 में अपनी बेटी की शादी के समय उसे कोई “स्त्रीधन” (women’s wealth) दिए जाने का कोई सबूत नहीं दिया था और 2016 में अपने तलाक के समझौते में दंपती ने “स्त्रीधन” का मुद्दा कभी नहीं उठाया था। सुप्रीम कोर्ट ने कहा, “ऐसा कोई सबूत नहीं है जिससे यह पता चले कि दावा किया गया “स्त्रीधन” बेटी के ससुराल वालों के पास था।”
क्या है “स्त्रीधन”?
“स्त्रीधन” वह संपत्ति है जिस पर किसी महिला को पूर्ण अधिकार होता है जिसका इस्तेमाल वह बिना किसी रोक-टोक के कर सकती है। महिला की शादी के समय या उससे पहले या फिर शादी के बाद या बच्चे के जन्म के समय उसे जो कुछ भी उपहार के रूप में मिलता है, चाहे वह आभूषण हो, नकदी हो, जमीन हो, मकान हो…उसे “स्त्रीधन” कहा जाता है। “स्त्रीधन” के दायरे में सिर्फ शादी के समय, बच्चे के जन्म या किसी त्योहार पर महिला को मिले उपहार ही नहीं आते बल्कि उसके जीवनकाल में उसे जो कुछ भी उपहार के रूप में मिलता है, वह सब इसके दायरे में आते हैं। इस धन पर सिर्फ और सिर्फ महिला का अधिकार होता है।
