News Haveli, प्रयागराज। इलाहाबाद हाई कोर्ट (Allahabad High Court) ने घरेलू हिंसा (Domestic Violence) मामले में पति और सास को छोड़कर शेष पारिवारिक सदस्यों के खिलाफ केस कार्रवाई रद कर दी है। न्यायमूर्ति अरुण कुमार सिंह देशवाल ने सोनभद्र की कृष्णा देवी और छह अन्य की याचिका पर यह आदेश पारित किया। अदालत ने कहा कि ठोस साक्ष्य के बिना दूर के रिश्तेदारों को घरेलू हिंसा मामले में फंसाना कानूनी प्रक्रिया का दुरुपयोग (abuse of legal process) है। हाई कोर्ट ने मामले में पति के पारिवारिक सदस्यों के खिलाफ मुकदमे की कार्यवाही रद्द कर दी लेकिन पति और सास के खिलाफ मामले को बरकरार रखा
इस मामले में वैवाहिक कलह (Marital Dispute) के चलते पीड़िता ने पति और उसकी मां तथा विवाहित ननदों के खिलाफ घरेलू हिंसा का मुकदमा दर्ज कराया था। सास और पांच अन्य रिश्तेदारों ने सोनभद्र के अतिरिक्त मुख्य न्यायिक मजिस्ट्रेट के समक्ष लंबित मामले में कार्यवाही को रद करने की मांग करते हुए हाई कोर्ट में याचिका दाखिल की।
हाई कोर्ट ने कहा कि घरेलू हिंसा का मुकदमा उन्हीं लोगों पर दर्ज किया जा सकता है जो पीड़िता के साथ साझा घर में रह रहे हों। इस न्यायालय को ऐसे कई मामले मिले जहां पति या घरेलू संबंध में रहने वाले व्यक्ति के परिवार को परेशान करने के लिए पीड़ित पक्ष दूसरे पक्ष के उन रिश्तेदारों को फंसाता था, जो पीड़ित व्यक्ति के साथ साझा घर में नहीं रहते या रह चुके हैं।
सास और पति के खिलाफ जारी रहेगी कार्रवाई
हाई कोर्ट ने कहा कि विवाहित बहनें और उनके पति अलग-अलग रहने के कारण अधिनियम के तहत आरोपित नहीं माने जा सकते। हालांकि हाई कोर्ट कोर्ट ने कहा है कि सास और पति के खिलाफ कार्रवाई जारी रहेगी क्योंकि दहेज से संबंधित उत्पीड़न सहित घरेलू हिंसा के इन पर विशिष्ट आरोप है। साथ ही हाई कोर्ट ने ट्रायल कोर्ट को 60 दिनों के भीतर मामले की सुनवाई पूरी करने का निर्देश दिया है।
