प्रयागराज। इलाहाबाद हाई कोर्ट ने कहा है कि जिलाधिकारी को बेसिक शिक्षा परिषद द्वारा स्थापित विद्यालयों के निरीक्षण और उसके कार्यों में हस्तक्षेप का अधिकार नहीं है। अदालत ने जिलाधिकारी के निर्देश पर किए गए विद्यालय के निरीक्षण और उसके आधार पर शिक्षिका के निलंबन आदेश को अवैधानिक करार दिया है। हाई कोर्ट ने जिलाधिकारी संभल और जिला बेसिक शिक्षा अधिकारी संभल से व्यक्तिगत हलफनामा मांगा है कि किस अधिकार के तहत उन्होंने (जिलाधिकारी ने) विद्यालय के कार्यों में हस्तक्षेप किया। संभल के एक विद्यालय में कार्यरत सहायक अध्यापिका संतोष कुमारी की याचिका पर यह आदेश न्यायमूर्ति जेजे मुनीर ने दिया है।

याची का पक्ष रखते हुए अधिवक्ता चंद्रभूषण यादव का कहना था कि जिलाधिकारी के निर्देश पर एसडीएम और खंड शिक्षा अधिकारी ने विद्यालय का संयुक्त रूप से निरीक्षण किया और शिक्षिका को कार्य में खराब प्रदर्शन के आधार पर निलंबित कर दिया गया। इस आदेश को हाई कोर्ट में चुनौती दी गई। हाई कोर्ट ने कहा कि प्रथम दृष्टया 25 अक्टूबर 2024 को पारित निलंबन आदेश कई कारणों से अवैधानिक है। प्रथम तो यह कि विद्यालय का निरीक्षण जिलाधिकारी के निर्देश पर उप जिलाधिकारी द्वारा किया गया जिनको बेसिक शिक्षा परिषद द्वारा स्थापित विद्यालयों के निरीक्षण का अधिकार नहीं है, न ही उसके कार्यों में उनकी कोई भूमिका है।

बेसिक स्कूल स्कूल बेसिक शिक्षा परिषद के तहत काम करते हैं जिनका नियंत्रण बेसिक शिक्षा अधिकारी के पास होता है। बीएसए अपर निदेशक, निदेशक और सचिव बेसिक शिक्षा परिषद के प्रति जवाबदेह है जिसका अध्यक्ष एक शिक्षा मंत्री होता है। डीएम राजस्व अधिकारी हैं। उनकी विद्यालयों के कार्यों में कोई भूमिका नहीं है। प्रथमदृष्टया स्कूल के निरीक्षण का आदेश बिना क्षेत्राधिकार का है।

बीएसए को भी माना बराबर का जिम्मेदार

हाई कोर्ट ने कहा कि बेसिक शिक्षा अधिकारी भी इसके लिए बराबर जिम्मेदार हैं। उन्होंने डीएम को यह नहीं बताया कि विद्यालय के निरीक्षण का आदेश देने का उनको अधिकार नहीं है, बल्कि उन्होंने डीएम के निर्देश का पालन किया तथा निलंबन आदेश उप जिलाधिकारी और खंड शिक्षा अधिकारी के संयुक्त निरीक्षण के बाद पारित किया गया। इसलिए यह माना जाएगा कि उक्त आदेश डीएम के निर्देश पर किया गया है।

हाई कोर्ट ने कहा कि अगर इन बातों को एक तरफ रख दिया जाए तब भी निलंबन आदेश शिक्षिका के खराब प्रदर्शन के आधार पर पारित किया गया है जो कि उसकी प्रोन्नति और इंक्रीमेंट में बाधा बन सकता है। कदाचरण का कोई आरोप नहीं है इसलिए निलंबन जैसा दीर्घ दंड अनुचित है। अदालत ने कहा कि निलंबन आदेश मनमाना है। हाई कोर्ट ने निलंबन आदेश को निलंबित करते अगली सुनवाई 7 जनवरी 2025 नियत की है।
